Party Wall Notice Generator Tool
1. Introduction
These Terms and Conditions (“Terms”) govern your use of the Party Wall Notice Generator Tool (the “Tool”) provided via our website.
By accessing or using the Tool, you agree to be bound by these Terms. If you do not agree, you must not use the Tool.
2. No Professional Advice
The Tool is provided for general informational purposes only and does not constitute legal, surveying, or other professional advice. If you would like us to go through your notice generated via our Tool with you, please contact us.
The generation of any party wall notice or related document using the Tool does not create any adviser-client, surveyor-client, or solicitor-client relationship.
You must not rely on the Tool as a substitute for obtaining advice from a suitably qualified professional.
3. Use at Your Own Risk
Your use of the Tool is entirely at your own risk.
While reasonable efforts may be made to ensure the Tool operates correctly and produces documents based on current general practice, no representation or warranty (express or implied) is given that:
- any document generated will be accurate, complete, or legally valid;
- the Tool is suitable for your specific circumstances; or
- the output will comply with the Party Wall etc. Act 1996 or any related legal requirements.
4. Exclusion of Liability
To the fullest extent permitted by law, the owner and operator of the Tool expressly exclude all liability for any loss or damage arising out of or in connection with:
- the use of, or inability to use, the Tool;
- reliance on any document, notice, or information generated by the Tool;
- any errors or omissions in the Tool or its outputs; or
- any action taken or not taken in reliance on the Tool.
This exclusion includes, without limitation:
- direct loss;
- indirect or consequential loss;
- loss of profits or business;
- loss of opportunity; and
- any legal, professional, or dispute-related costs.
5. User Responsibility
You acknowledge and agree that:
- you are solely responsible for ensuring compliance with all applicable laws, including the Party Wall etc. Act 1996;
- you are responsible for the accuracy of all information entered into the Tool;
- you are responsible for reviewing and validating any document generated;
- you are responsible for properly serving any notice and managing any subsequent process; and
- errors in your input may result in invalid or ineffective notices.
6. No Warranties
The Tool is provided on an “as is” and “as available” basis without any warranties of any kind, whether express or implied, including but not limited to:
- fitness for a particular purpose;
- satisfactory quality; and
- non-infringement.
7. Fees, Digital Content and No Right to Cancel
7.1 The Tool is a paid digital service. By purchasing access to and using the Tool, you agree to pay the applicable fee as stated at the point of purchase.
7.2 The service provided through the Tool constitutes digital content supplied in a non-tangible medium.
7.3 By proceeding with the purchase and accessing the Tool or downloading any document, you:
- expressly request immediate performance of the contract; and
- acknowledge and agree that you will lose your statutory right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 once the digital content has been accessed.
7.4 Accordingly, no refunds shall be provided once:
- the Tool has been accessed following purchase; or
- any notice or document has been generated, viewed, or downloaded.
7.5 Nothing in this clause affects your statutory rights where digital content is not of satisfactory quality, not fit for purpose, or not as described.
8. Indemnity
You agree to indemnify and hold harmless the owner and operator of the Tool from and against any claims, liabilities, damages, losses, or expenses (including legal costs) arising out of or in connection with:
- your use of the Tool;
- your reliance on any documents generated; or
- your breach of these Terms.
9. Limitation
Nothing in these Terms shall exclude or limit liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation; or
- any liability that cannot be excluded or limited under English law.
10. Availability and Changes
We reserve the right to modify, suspend, or withdraw the Tool at any time without notice and without liability.
11. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction.
